What the Insurer Must Do in the First 90 Days of Your Claim

Within one working day after you file your claim form, your employer must authorize treatment under state guidelines, up to $10,000, while the state investigates the claim, as the state claims process chart shows. The insurer should then send one of three notices within 14 days: accepted, delayed, or denied. A delayed claim means an investigation of up to 90 days, and a claim without a decision by day 90 is presumed accepted.

Each notice calls for a different next step. Our case managers coordinate with your medical providers and analyze the insurance claim, while your attorney develops the legal strategy and advocates for your benefits in insurance negotiations, hearings, and trials as appropriate.

Timing matters to treatment, too. One client who broke two bones in a fall at work described a long wait for recommended tests in a review, then added, “I needed help fast.” The client credited our communication when recommending the firm. Every claim runs differently, and one client's experience doesn't predict another's.

Who Handles What on Your Los Angeles County Healthcare Injury Claim

Your claim involves medical providers, an insurance company, appointments, hearings, and mileage reimbursements, and no single person at our firm handles all of it. We assign you a team of four, and each member has defined responsibilities.

Your assigned team includes:

  • Attorney – Represents you in insurance negotiations, hearings, and trials as appropriate, and develops the legal strategy for your claim.
  • Case manager – Coordinates with your medical providers and analyzes the insurance claim.
  • Case assistant – Manages your case file, your appointments, and your reimbursements.
  • Team assistant – Helps maintain your documentation and answers additional questions.

This division means appointment or reimbursement questions go to your case assistant, and legal questions go to your attorney. You reach the team by phone, text, email, or online scheduling.

Large Claims We've Handled for Health Care Workers Across California

Health care employees bring us claims from many job settings.

Our results for health care workers include:

  • $1,000,000 – Secured for a hospital worker involved in a drug study
  • $735,000 – Secured for a medical assistant in Mt. Shasta

A past result doesn't determine the outcome of any other claim. What a claim is worth depends on the injury, the medical evidence, and the facts of the individual case, which is why we begin with an evaluation of your circumstances.

Frequently Asked Questions About Los Angeles County Healthcare Injury Claims

As a medical professional, you may face unique administrative hurdles when navigating the workers' compensation process. We compiled these common questions to help clarify how our legal team approaches your medical and financial recovery.

How Do I Prove a Cumulative Trauma Injury?

Proving a repetitive motion injury requires thorough medical documentation connecting your daily job duties to your physical condition. We gather detailed employment records, work with respected medical evaluators, and build a timeline that illustrates how years of patient transfers, charting, or lab work led to your current diagnosis.

How Can Legal Representation Help with Stalled Medical Treatment?

When an insurer delays authorization for prescribed physical therapy or surgery, our team files appeals and requests expedited hearings. We also use our alternative network of providers so you can get the care you need while we handle the legal disputes with the insurance company.

What Happens During an Initial Case Evaluation?

You describe your circumstances, including your job, your injury, and any decisions the insurer has made so far. We then explain the next steps open to you. Evaluations take place by phone or in person.

Does My Claim Work Differently If I Work for a Federal Facility?

Yes. Federal employees' workers' compensation claims follow a federal system with its own procedures, so the 14-day and 90-day deadlines above apply to California claims only. We represent federal employees, so tell us at the start if a federal agency, such as a Veterans Affairs medical center, employs you.

Workers' Comp FAQ

  • What benefits can I seek with a workers' compensation claim in Oakland?
In California, if you've been injured at work or diagnosed with a work-related illness, you can file a workers' compensation claim to seek benefits that cover a range of expenses. These benefits include medical costs, lost wages due to time off work, compensation for future earnings if you're unable to return to work, and expenses related to retraining or skill enhancement if you need to switch professions. Given Oakland's high cost of living, it's important to ensure your claim is accurately filed to receive all the benefits you're entitled to.
  • What If My Employer Denies My Workers’ Compensation Claim Because I’m a Seasonal Worker?

Employers in California are legally required to provide workers' compensation coverage to all employees, including seasonal workers. If your claim is denied, it's advisable to consult with a workers' compensation attorney to understand your rights and explore options for appealing the decision.

  • Am I Eligible for Workers’ Compensation?

In California, all employees are eligible for workers’ compensation with very few exceptions. If you are classified as an “employee” (rather than an “independent contractor”), you are eligible to receive benefits. This is true regardless of how many employees your employer has, how many hours you work, how much you make, whether you work part-time or full-time, or whether you are a seasonal worker. Additionally, undocumented workers are also eligible for workers’ compensation granted they meet all other eligibility requirements. In contrast, independent contractors and certain other workers, including some volunteers, household workers who are employed by a family member, and others, are not able to file for workers’ compensation benefits.

  • Do independent contractors get workers’ compensation in California?

No, most independent contractors are not covered by workers’ compensation insurance that is provided by their employer. The law does not require most employers to offer this sort of employment benefit to independent contractors. To get workers’ comp as an independent contractor, you will usually have to purchase a policy on your own.

  • Do I need to prove my employer was at fault to receive workers' compensation benefits?

No, you do not need to prove your employer was at fault to receive workers' compensation benefits in California. The state operates under a no-fault system, which means that as long as your injury or illness is work-related, you can file a claim for workers' compensation. This system is designed to simplify the process for injured workers to receive their rightful benefits without the need for proving fault.
